D. Terminology (705 ILCS 405/1-3):
Specific terminology is used in the Illinois Juvenile Court Act. Students should be able to define and use the words contained in the Act correctly. Furthermore, they should be able to apply the concepts outlined in the following definitions when dealing with minors:
1. Adjudicatory Hearing (1): A hearing to determine whether the allegations of a petition for a minor under the age of 18 who is abused, neglected, or dependent, or requires authoritative intervention, or addicted, respectively, are supported by a preponderance of the evidence (civil trial standards) or whether the allegations of a petition under 5-520, that a minor is delinquent are proven beyond a reasonable doubt. In Article V of the Juvenile Court Act and the adult court system this hearing would be called a “Trial.”
2. Adult (2): A person who is 21 years of age or older.
3. Agency (3): A public or private childcare facility that is legally authorized and licensed by the State of Illinois for placement and/or institutional care for minors.
4. Association (4): Any organization, public or private, that engages in welfare functions that include services to or on behalf of children, but is not considered an agency by law.
