UNIT II - ABUSED, NEGLECTED, OR DEPENDENT MINORS (ARTICLE II, 705 ILCS 405/2)

K. Kinds of Dispositional Orders (705 ILCS 405/2-23): This section allows the courts to decide upon different kinds of orders of disposition regarding any minor who is under 18 years of age, has been found to be neglected or abused, and has been declared a ward of the court. The court's options include:

  1. Allow the minor to continue in the custody of his/her parent, guardian or legal custodian.

  2. Place him or her per the guidelines of Section 2-27 of the Juvenile Court Act.

  3. Restore the minor to the custody of the parent, guardian, or legal custodian under the condition that the parent, guardian, or legal custodian cooperates with the Illinois Department of Children and Family Services or other agency and comply with the terms of the after-care plan. Failure to do so will risk the loss of custody of the child and possible termination of parental rights.

  4. Order the minor partially or completely emancipated.
It is important to note that in any case in which a minor is found by the court to be neglected or abused under Section 2-3, custody of the minor will not be restored to any parent or guardian who has abused or neglected his/her child until a hearing has been held to determine the best interests of the minor and the fitness of the parent to care for the minor.

A minor under 18 years of age who has been found to be dependent under Section 2-4 may be placed in accordance with Section 2-27 or may be ordered partially or completely emancipated under the Emancipation of Mature Minors Act.
