D. Alternative Voluntary Residential Placement (705 ILCS 405/3-6): A minor and his/her parent, guardian or custodian may agree to an arrangement for placement without a court order. The crisis intervention agency serving the community in which the minor resides will assist the law enforcement agency in this placement process. Furthermore, the agency will assist the minor in being placed in a home or shelter as agreed upon by the minor and his/her parents/guardian.

However, if the minor, parent or guardian cannot agree to placement or the continuance of placement, and/or the minor refuses to go home, a petition may be filed with the court alleging that the minor requires authoritative intervention. These petitions are normally filed by the crisis intervention agency, but nothing prohibits a Law Enforcement Officer from filing this petition with the court.
