UNIT III - MINORS REQUIRING AUTHORITATIVE INTERVENTION ARTICLE III - 705 ILCS 405/3)

The minor must be delivered without unnecessary delay to the court or to the court-designated location for the reception of minors.

An Officer taking a minor into custody without a warrant shall, if the minor is not immediately released, notify the parent or guardian of the custody of the child and also deliver him/her without unnecessary delay to the nearest juvenile police officer.

If the Officer determines the true identity of the minor, he/she may be released to the parent or guardian if he/she was taken into custody for a status offense. If the minor is so released, the Officer must immediately notify a Juvenile Police Officer of the custody and release.

A Juvenile Police Officer has an array of dispositions for handling a juvenile considered to be a MRAI, including:

  1. Issue a station adjustment with release of the minor;

  2. Issue a station adjustment with release of the minor to a parent or guardian;

  3. Issue a station adjustment with release of the minor to a parent, and referral of the case to community services;

  4. Issue a station adjustment with release of the minor to a parent, referral of the case to community services with informal monitoring by a Juvenile Police Officer;

  5. Issue a station adjustment and release of the minor to a third person pursuant to agreement of the minor and parents;

  6. Issue a station adjustment and release of the minor to a third person pursuant to agreement of the minor and parent, and referral to community services;

  7. Issue a station adjustment and release of the minor to a third person pursuant to agreement of the minor and parent, referral to community services, and informal monitoring by a Juvenile Police Officer;

  8. Release of the minor to his/her parents and referral to a county juvenile probation officer or other officer designated by the court;

  9. Release of the minor to officials of his/her school during regular school hours;

  10. If the Juvenile Police Officer reasonably believes there is an urgent and immediate necessity to keep the minor in custody, he/she will deliver the minor without unnecessary delay to the court or court- authorized location; and,

  11. Any other appropriate action, with the consent of the minor and parent.
Remember, Officers must make sure parents are notified that their child has been taken into custody and the location at which the child is being held.
