Part 1 - General Provisions (720 ILCS 405/Article V, Part 1)

This unit will examine the philosophy of 'Balance and Restorative Justice' and will provide students with definitions for several legal terms used throughout Article V, including exclusive, concurrent, and excluded jurisdiction. It is expected that students will gain an increasing awareness of the ways in which the terms used in the Juvenile Court Act are beginning to more closely model the terminology used in the adult criminal system in Illinois.

Criminal offenses which exclude minors from the Juvenile Court Act, legal provisions for charging a minor as an adult, and special conditions for prosecution will be reviewed. Furthermore, ways in which the court can impose or restrict evidence in a juvenile delinquency proceeding will be addressed, as will legal protections for minors under the age of 15 who are arrested for certain offenses.
