H. Excluded Jurisdiction (705 ILCS 405/5-130)
Under this Section, juveniles who commit certain serious crimes will be tried in adult criminal court and will face the same range of penalties available for adults. These crimes include first degree murder, aggravated criminal sexual assault, aggravated battery committed with a firearm.
This Section affords a juvenile accused of any of the crimes listed above a trial by jury. Any juvenile who is tried and convicted as an adult will be incarcerated separate from adult prisoners until he or she is sent to adult prison at some point between his or her 18th and 21st birthdays. Convictions in criminal court become a part of the minor's permanent record.
